Heart-Throbs Schipperkes Show Prospect Agreement

Hereinafter referred to as "Show Dog/Bitch" has been sold to Buyer by Seller as "Breed/show prospect". Breed/show prospect shall be understood to mean that no disqualifying cosmetic faults as defined in the Schipperke standard are evident at time of sale and further that no genetic disorders are immediately apparent.

GENERAL

  • Seller shall not be held responsible for the development of non-genetically derived disqualifying faults, diseases, or disorders which are due to Buyer's negligence.
  • Buyer agrees that under no circumstances shall Show Dog/Bitch be used for breeding purposes until proper health testing has been done and Championship obtained unless other wise agreed upon by seller. If Buyer violates this condition all guarantees are null and void. Seller strongly recommends that the following tests be made, Thyroid, CERF, Patella and CHIC. OFA provides certification for thyroid. The Canine Eye Registration Foundation (CERF) provides certification for eyes, and Patella’s OFA provides certification for patella’s. Buyer agrees to obtain the certification of CHIC on the dog before breeding. The seller strongly suggests that the dog also be tested for cardiac, hips/elbows and LCP which OFA provides the certifications for but these are optional for a CHIC certification.
  • In the event that Show Dog/Bitch is co-owned, Buyer has sole responsibility.
  • Show Dog/Bitch will only be fed top quality food and fresh water is available at all times to him/her. Show Dog/Bitch will always have safe, comfortable and adequate shelter. The primary residence of the purchaser is as well the primary residence of Show Dog/Bitch.
  • Show Dog/Bitch's vaccinations and health care will be kept current and he/she will receive heartworm preventatives. 
  • Seller retains the right of first offer of purchase should the Buyer decide to sell Show Dog/Bitch for any reason at a later date. Buyer will notify Heart-Throbs in writing. Purchase price shall be no more than the price paid to the seller on the above date. If this Show Dog/Bitch is sold, this contract becomes null and void. Heart-Throbs must be notified as to where the Show Dog/Bitch goes. (this is for record keeping as well as assuring that all pups are in happy healthy homes)
  • Should Show Dog/Bitch develop any disqualifying faults as defined in the Schipperke Standard, or be diagnosed with any genetically derived medical disorder which is attested to by two unassociated veterinarians, thereby causing Buyer and Seller to agree that Show Dog/Bitch cannot ethically be bred, Seller will, upon provision of veterinary reports and, where applicable, Orthopedic Foundation for Animals (OFA) report, or Canine Eye Registration Foundation (CERF) certification, replace the Show Dog/Bitch with one of equal or greater value, when one is available. 

    Should Buyer choose to keep Show Dog/Bitch, the Show Dog/Bitch must be spayed or neutered before receiving the replacement of a breed quality puppy, and spay/neuter certificate must be provided to Heart-Throbs by the Buyer's veterinarian of choice that also contains the dogs proper identification or microchip number. Buyer must pay any shipping or miscellaneous charges associated with transport of replacement puppy. Buyer is entitled to one (1) replacement puppy.
  • All shipping costs for dogs replaced for any reason will be the responsibility of the Buyer.
  • This dog’s registered name shall contain Heart-Throbs at the beginning of the name, no other prefix or suffix will be used unless written permission from Heart-Throbs is obtained.
  • If, by the time the Show Dog/Bitch is 24 months old it does not appear to be of show/breeding quality, the seller will, upon receipt of a veterinarian's certificate of sterilization that also identifies the above dog, provide a replacement puppy of show/breeding quality when one is available.  The determination of quality is to be made by the seller or by a person or persons appointed by the seller.  This determination may be based in part on the dog's show record.
  • The Buyer agrees to show this puppy for conformation and, if possible, to the completion of its AKC championship, at the expense of the Buyer.  

CARE AND CONDITION:

The Buyer has the sole responsibility for properly feeding and developing the functioning Show Dog/Bitch. To the best of his/her ability, the Buyer will provide for a safe and healthy environment. He/She will never knowingly nor through neglect, place the Show Dog/Bitch in harm's way. The Buyer will also, to the best of his/her ability, keep the Show Dog/Bitch in proper health and condition for show ring competition. The buyer will provide a fenced yard to prevent the Show Dog/Bitch from running the streets. The Buyer will provide the care of a qualified veterinarian in the case of illness or injury, and for preventative health care. The buyer will provide proper nutrition as advised by the Breeder or the veterinarian. The Buyer will provide shelter from the weather, both in winter and in summer. The Buyer will at NO TIME allow the Show Dog/Bitch to ride outside of a travel crate, while in or on the bed of a pick up truck or other open vehicle. This dog is micro-chipped, purchaser agrees to keep the records up to date with AKC or foreign registry service. Regarding any changes in address and contact information.

 

 

HEALTH GUARANTEE

  • Seller guarantees that Show Dog/Bitch is in good health and has received appropriate medical inoculations and care including inoculations and worming. Seller will provide Buyer with a medical record detailing treatment Show Dog/Bitch has received under Seller's care. Future care Seller feels is essential to Show Dog/Bitch's well being and must be maintained.
  • Seller guarantees that Show Dog/Bitch is free of life threatening diseases, or disabilities or genetic diseases (i.e., heart murmurs, etc.) for the life of the dog. Should life threatening diseases or disabilities be discovered by Buyer within 72 hours after receipt of Show Dog/Bitch, and attested to in writing to Seller by Buyer's veterinarian. Seller will provide Buyer with a replacement breed quality puppy as soon as such a puppy is available to Seller, or refund 100% of purchase price. Seller strongly recommends that Buyer have Show Dog/Bitch examined by a licensed veterinarian of Buyer's choice within 72 hours of receipt of Puppy.

TEMPERAMENT

  • Seller strongly recommends that Buyer attend socialization/conformation, and/or obedience classes with Show Dog/Bitch and provide proper socialization opportunities for Show Dog/Bitch.
  • Seller shall not be held responsible for acts of Show Dog/Bitch which are due to Buyers negligence. No provisions will be made for owners who are unable to train, condition or show the dog to its full advantage. However, if the owner is unable to win with the dog, it may be returned to the seller at the buyer’s expense for evaluation. If the seller determines the dog not to be of show quality along with two other breeders, one of sellers choice and one of buyers choice, it will be replaced with a show quality dog at the next litter and after being returned to the seller.
  • Heart-Throbs reserves the right to fine the Buyer $1500.00 or repossess Show Dog/Bitch if a breach of contract occurs.

If this dog exhibits any or all of the above defects mentioned, a replacement dog will be given to the purchaser in exchange for said dog’s registration papers and certification that said dog has been neutered or destroyed and the above dog may or may not have to be returned to he seller at purchaser’s expense. If said dog is to be destroyed, guarantee is valid ONLY if the seller gives prior approval. Seller will replace puppy within one year with an equal quality or better puppy of the same sex and only one (1) replacement puppy is due..

I hereby understand and agree to all the terms and conditions set forth in this contract. I understand this contract is enforceable under current American Kennel Club rules regarding Contracts and Registration Matters. I understand that failure to comply with this contract as written will result in permanent loss of the right to have the dog registered in my/our name(s). .If either party is forced to take legal action to enforce any part of this contract, action shall be in the county of the Breeder's residence.  Any legal fees and court cost shall be the responsibility of the party found to be at fault.
